Three undergrads file FR

Three undergrads from the Medicine Faculty of the Kelaniya University have filed a Fundamental Rights petition in the Supreme Court seeking an Interim Order restraining the Sri Lanka Medical Council (SLMC) from accepting or any further processing applications from the 81 SAITM students not registered and awarded the MBBS from the Kotelawala Defence University (KDU).

When the petition came up before three-judge-bench headed by Chief Justice Nalin Perera, the matter was fixed for January 24.

The Petitioners are advised that the law as at date requires the students with MBBS (SAITM) qualifications to be first absorbed into KDU, then be awarded with MBBS (KDU), upon completion of additional training as the case may be and it is only then that they become eligible to seek provisional registrations at SLMC. The petitioners state that despite the procedure set out in the KDU Act, SLMC’s decision to directly absorb students with MBBS (SAITM) for provisional registrations is arbitrary and unreasonable as much as it is contrary to the provisions of the Act.

The petition was filed by counsel Chrishmal Warnasuriya.
