Hathras Horror: 3 acquitted, 1 convicted of murder; None charged for rape despite victim’s ‘dying declaration’

New Delhi: Three out of the four accused in the 2020 Hathras Rape and Murder case have been acquitted by a special court in Uttar Pradesh. The court did not convict any of the accused of rape despite the victim accusing three acquitted of sexual assault before dying.

Besides that, prime accused Sandeep Singh has been convicted of culpable homicide not amounting to murder and under sections of the SC/ST Act, reported LiveLaw. However, Sandeep, too, has not been convicted of rape charges.

The family of the victim will challenge the court’s decision on finding the same ‘unsatisfying’. The case pertains to the alleged rape, torture and murder of a 19-year-old Dalit girl by four men belonging to the upper caste in Uttar Pradesh’s Hathras.

The teenager died while undergoing treatment in Delhi which followed a hurried cremation of her body by the Uttar Pradesh Police. As per the allegations levelled by the victim’s family, they were barred to attend her cremation and to even have a look at their daughter for the last time.

The Police’s act had shaken the nation once again while the latter was still processing the horrific details of the death of the 19-year-old.

It is worth noting that the matter was transferred to the Central Bureau of Investigation (CBI) which found out that the UP Police had ignored the victim’s statement where she had accused the three —  Ravi (35), Luv Kush (23), and Ramu (26) — of sexual assault.

The teenager had recorded her statement with the district magistrate. The CBI further mentioned the UP Police for ignoring the victim’s statement in a charge sheet.

“During her examination on September 22, the victim categorically stated that she was gang-raped by the four accused persons; she also named them in her dying declaration… It establishes that on September 14, the victim was gang-raped at the bajra field when she was alone. The investigation also revealed that all four accused were present in the village or nearby place, which corroborates the allegation of the victim,” said CBI, reported The Wire.
