Sena vs Sena: SC turns down plea seeking stay on EC’s decision

New Delhi: The Supreme Court on Wednesday turned down a plea filed by the Uddhav Thackeray gorup that challenged the Election Commission’s decision to allot title of ‘real’ Shiv Sena to Eknath Shinde group.

However, a bench headed by Chief Justice of India DY Chandrachud refused to order a stay at this juncture, as per a report published by the LiveLaw.

The court allowed the Uddhav Thackeray group to retain the title and the symbol given to them by the Election Commission earlier. In view of the Maharashtra Assembly by-elections, the EC had alloted the Uddhav group as the Shiv Sena (Uddhav Thackeray group) and the symbol of “flaming torch”.

This comes after the Uddhav Thacekray camp submitted to the court that the Shinde group is taking over the offices and bank accounts of Shiv Sena, which needs urgent attention.

Appearing for Uddhav Thackeray, senior Advocate Kapil Sibal had sought status quo on the EC’s decision for stripping off the title of official Shiv Sena from his client to give it to the Shinde group.

“Something which is a part of the order we can decide upon. We cannot stay an order at this stage. They’ve succeeded before the ECI. Any further action is not based on EC order. Then you have to pursue other remedies of law”, CJI said, quoted LiveLaw.
