The Supreme Court and the local court of Varanasi will resume hearing on Thursday in the Gyanvapi Masjid case.
The Supreme Court on Tuesday asked the district magistrate of Varanasi to ensure that the area where a ‘Shivling’ was found in the premises is protected without restricting the right of worship of the Muslim community. Meanwhile, the Varanasi court granted two more days to the survey team appointed by it to submit its report.
What is on the agenda of Varanasi court on Thursday regarding Gyanvapi case:
1. The court will hear the petition seeking permission to worship the ‘Shivling’ found in the premises. The same petition has also sought demolition of basement walls and removal of debris to collect more evidence.
2. Another petition seeking a direction to transfer the pipeline (through which water is supplied to worship worshipers) from the sealed area of the Gyanvapi Masjid was filed by public prosecutor Mahendra Prasad Pandey. A hearing on this will also take place on Thursday.
3. The court will also hear a petition filed by the Hindu side, seeking that Ajay Kumar Mishra be included in the survey work. A Varanasi court on Tuesday removed him from its three-member survey team for displaying “irresponsible behavior towards the discharge of his duties” after he was accused of deploying a private cameraman to leak information to the media. In its affidavit, Hindu Sena said that the history of Kashi Vishwanath-Gyanvapi dispute is being ignored. The group argued that the Places of Worship Act was not applicable as the dispute was going on before independence.
2. On Thursday, the apex court will hear the plea of Anjuman Intejamiya Masjid, the management committee that manages the Gyanvapi mosque in Varanasi.
Knowledgeable controversy
A petition filed in a Varanasi court in 1991 claimed that the Gyanvapi Masjid was built on the orders of Aurangzeb during his reign in the 16th century by demolishing a portion of the Kashi Vishwanath temple.
The petitioners and the local priests sought permission to offer prayers in the Gyanvapi Masjid premises. The Allahabad High Court had in 2019 ordered a stay on the ASI survey requested by the petitioners.
The current controversy began when five Hindu women demanded regular worship of Shringar Gauri and other idols inside the Gyanvapi mosque complex.
Last month, a Varanasi court had ordered a videography survey of the Gyanvapi mosque complex after five Hindu women filed a petition seeking worship behind the western wall of the complex.
Earlier this week, lawyers for the Hindu side claimed that a ‘Shivling’ was found in a well in the mosque premises. The Muslim side has denied this claim, saying that the structure being referred to is a fountain.
