Gyanvapi case: Varanasi court to hear Masjid Committee's argument on May 26

Varanasi:

The court of the senior-most judge in Varanasi, hearing the Gyanvapi mosque case on the Supreme Court’s order, today said it will first hear the mosque committee’s argument that filming inside the mosque last week was illegal.

The hearing will begin on Thursday (May 26). It also ordered both the parties to file affidavits with their objections to the survey report within a week.

The Masjid Committee said that filming in the mosque is in violation of a 1991 law, which prohibits changing the character of any place of worship in the country. It wanted the “maintenance” case to be heard first, which the court has agreed to.

In the order passed on Friday, the Supreme Court had asked the Varanasi court to decide on priority whether the petition leading to the survey and survey at the Gyanvapi mosque was ‘maintainable’.

Abhay Nath Yadav, counsel for the Masjid Committee, said, “I told the court that it is an order of the Supreme Court that our application should be heard first saying that the matter is not maintainable. I have submitted my application and the Supreme Court. The order also read. The opposing counsel said that he needs more documents and time. Objected our application, but I said maintenance should be decided first.”

A fresh petition was filed in the court seeking permission to worship the “shivalinga”, which was claimed to have been found in the mosque premises during a trial court-ordered videography survey.

The Supreme Court on Friday transferred the Gyanvapi-Sringar Gauri Mandir case from a civil judge (senior division) to a district judge.

The top court had last week said that considering the “complexity” and “sensitivity” of the issue, it is better that a senior judicial officer with more than 25-30 years of experience to handle the matter.

The Hindu side had argued that since the court-appointed commission had completed its work, the opponents should present their objections to it.

Mohd Tauheed Khan, counsel for Anjuman Intejamiya Masjid Committee had argued that the writ was not sustainable and should be dismissed.

Earlier, on Monday, Mahant of Kashi Vishwanath Temple Dr VC Tiwari had filed a fresh petition for regular worship of the Shivling, which he found in the Gyanvapi mosque premises.
