The Colombo District Court yesterday issued an injunction order and notice to former President Maithripala Sirisena to appear before Court on May 4 regarding his holding of the Chairmanship of the Sri Lanka Freedom Party.
Colombo Additional District Judge Dulani S.Weeratunga issued the order after considering a case filed by a member of the SLFP party Committee Montague Sarachchandra, a resident of Malabe seeking an injunction order restraining former President Maithripala Sirisena from holding the chairmanship of the Sri Lanka Freedom Party (SLFP).
Colombo District Court has issued notices to former President Maithripala Sirisena, General Secretary Dayasiri Jayasekara, Treasurer Lasantha Alagiyawanna and National Organizer Duminda Dissanayake.
According to the SLFP Constitution, a person who is elected as the President can hold the post of SLFP Chairman, but the case was filed stating that it is not legal to hold the post of chairman after he ceased to be the President.
The plaintiff told Court that holding the post of party chairman while holding the post of patron of the party was an invalid act in the eyes of the law and that the special meeting of the executive committee held on February 25, 2022, which held for the post of chairman, was held in violation of the party Constitution. He also said that the meeting held without even inviting former President Chandrika Bandaranaike Kumaratunga was illegal.
The Presidential Commission of Inquiry has found that the accused Maithripala Sirisena is criminally responsible for the Easter attack and the Commission has recommended that the Attorney General should file a case against former president Sirisena under the Penal Code for the Easter attack which killed more than 250 people The plaintiff has stated that the recommendations have not been challenged by any Court so far.
After considering the submissions made by Attorney Dinesh de Silva, District Court Judge issued notices to the defendants and directed them to appear before the court on May 4.
