Gota allowed to go abroad

Former Defence Secretary Gotabaya Rajapaksa whose passport was impounded in connection with the D.A. Rajapaksa Museum case was yesterday temporally permitted to travel abroad by the Permanent High Court-at-Bar.

The Trial-at-Bar bench comprising High Court Judges Sampath Abeykoon (President), Sampath Wijeratne and Champa Janaki Rajaratne allowed Gotabaya Rajapaksa to travel abroad between March 26 and April 12.

Meanwhile, four other accused who had been indicted regarding D.A. Rajapaksa Museum case yesterday raised preliminary objections against the indictments.

President’s Counsel Anil Silva with Kalinga Indatissa PC appearing for the accused alleged that the charges have been filed against their clients contrary to the provisions of the Criminal Procedure Code. The Attorney General’s reply to these submissions is to be made on March 28.

On February 11, the Permanent High Court-at-Bar decided to overrule preliminary objections raised by former Defence Secretary Gotabaya Rajapaksa and six others in connection with the D.A. Rajapaksa Museum case citing Permanent High Court-at-Bar has jurisdiction to hear this case.

Indictments were filed against seven accused former Defence Secretary Gotabaya Rajapaksa, members of the director board of Land Reclamation and Development Corporation (LRDC) Chairman Prasad Harshan de Silva, Bhadra Udulawathi Kamaladasa, Sudammika Keminda Artigala, Saman Kumara Abraham Galappatti, Devage Mahinda Saliya and Srimathi Mallika Kumari Senadheera under seven counts for allegedly misappropriating LRDC funds of Rs.33.9 million.

Senior State Counsel Wasantha Perera appeared for the Attorney General. President’s Counsel Ali Sabry and Anil Silva PC with Kalinga Indatissa and counsel Nalinda Indatissa appeared for the accused.
